On the Duty of the Legislatures of the United States to Complete the Nation’s Compliance with the Convention against Torture

The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT) has been binding on the United States as a matter of treaty law for more than three decades, yet the domestic legislative work the treaty requires has never been completed. This memorandum, issued by the Institute for the Advancement of Justice & Human Rights on behalf of the People of the United States and addressed to the federal Congress and to the legislatures of the several States, identifies the unfinished legislative work with specificity and, by delivery, places the recipients on formal notice of it. The Institute treats the completion of UNCAT compliance as a duty of the state party as a whole; the memorandum accordingly assumes that neither the federal Congress nor any single state legislature can discharge the duty alone, and calls on all of them to act.

The memorandum walks the recipients through the specific legislative steps the Convention requires. Under Articles 2 and 4, the United States must maintain criminal statutes that reach every act of torture and every act of cruel, inhuman, or degrading treatment or punishment (CIDT) committed by or with the consent or acquiescence of a public official, and those statutes must be free of geographic, jurisdictional, and statute-of-limitations exceptions that would leave the prohibition unenforceable in ordinary domestic cases. Under Article 14, the United States must guarantee an effective, prompt, and adequate civil remedy — including compensation, rehabilitation, restitution, satisfaction, and guarantees of non-repetition — that reaches every survivor within the jurisdiction and is not swallowed by the layered immunities and abstention doctrines that dominate the current federal-court remedial landscape. Under Article 15, the United States must exclude every statement obtained by torture or CIDT from any proceeding at which it might otherwise be introduced. Under Articles 12 and 13, the United States must guarantee that every credible allegation is received, investigated promptly and impartially, and adjudicated by an authority independent of the officials whose conduct is under review. And under Article 2, paragraph 2, the United States must bring the entire body of state and federal procedural law — the reservations, understandings, and declarations attached to the instrument of ratification; the doctrines of immunity, abstention, preclusion, and standing by which UNCAT-cognisable claims are today dismissed short of the merits — into conformity with the Convention’s non-derogable standards.

The memorandum functions both as analysis and as formal notice. On receipt, the federal Congress and each of the fifty state legislatures are on record as to the gap between current United States law and the Nation’s binding treaty obligations, and as to the concrete legislative steps by which the gap can be closed. The instrument accordingly serves, in any subsequent Committee-facing report or judicial review, as evidence that the state party’s principal law-making authorities were made specifically aware of what completion of UNCAT compliance requires; and it serves, in the ordinary work of legislative drafting, as a checklist against which any proposed statute or procedural rule bearing on torture or CIDT can be measured for treaty-conformity before it is enacted.

On the Duty of the Prosecutors in the United States under the Convention against Torture

This document is a combined memorandum and record of notice, issued by the Institute for the Advancement of Justice & Human Rights on behalf of the People of the United States and addressed to every officer in the United States who exercises criminal charging authority — United States Attorneys and their assistants, State Attorneys General, District Attorneys and City Attorneys, and municipal prosecutors — together with the disciplinary, judicial-conduct, and inspector-general authorities to whom those officers ultimately answer. Its purpose is to set out, in a single instrument, the prosecutorial duties that flow from United States ratification of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT), and, by delivery of that instrument, to place the recipients on formal notice of the standards UNCAT imposes on the exercise of their prosecutorial discretion. The memorandum is issued under the same authority and in the same form as the Institute’s companion memorandum to the legislatures; it treats prosecutorial discretion as a state-party compliance instrument, not as an unreviewable private judgment.

The memorandum enumerates the substantive duties the Convention imposes on prosecutors in the United States. Among them: the obligation, under Articles 4, 6, 7, and 12, to receive and to promptly and impartially investigate every credible allegation of torture or of cruel, inhuman, or degrading treatment or punishment (CIDT) committed by or with the consent or acquiescence of a public official; the obligation to charge such conduct under the federal and state statutes actually available (including 18 U.S.C. §§ 2340–2340A, § 242, § 249, the war-crimes and genocide provisions where they apply, and the state-law criminal analogues that supply the day-to-day charging vehicle); the obligation, under Article 15, to refuse to introduce or to rely on any statement obtained by torture or CIDT as evidence in any proceeding; the obligation to record and to explain charging declinations so that the United States can demonstrate to the Committee against Torture the good-faith exercise of prosecutorial discretion the treaty presupposes; and the concomitant obligation of the disciplinary and oversight authorities to treat systematic non-compliance with these duties as a compliance failure of the state itself rather than as a private ethical matter. Recipients are on record as to these standards from the moment the memorandum is served; the instrument accordingly functions both as analysis and as evidence, in any subsequent Committee-facing report or judicial review, that notice was given.

This General Comment sets out the institutional posture and limits of advisory opinions issued by the Institute for the Advancement of Justice & Human Rights, a California non-profit corporation structured by reference to the Paris Principles. It explains who the IAJ is and what its independent purpose comprises, situates IAJ advisory opinions within the broader institutional traditions of advisory work — international tribunals, the legal-academy synthesizing institutions, and Paris Principles–compliant national human rights institutions — and documents the continuing absence of a GANHRI-accredited NHRI in the United States, in light of which the IAJ performs NHRI-like documentation, investigation, advisory, and public-education functions. It states candidly what IAJ advisory opinions are not (they are not adjudications, not promulgations of law, not legal advice, and not predictions of success in any court or proceeding) and what they affirmatively are (reasoned civil-society analysis of questions of domestic and international human-rights law, addressed to complainants, counsel, courts, scholars, treaty bodies, and Special Procedures). It applies, by its terms, to every advisory opinion, recommendation, and analytical publication subsequently issued under the IAJ name, so that individual publications may incorporate it by reference rather than restate its caveats.

ON THE BOUNDED APPLICABILITY OF LEHMAN v. LYCOMING COUNTY CHILDREN’S SERVICES AGENCY, 458 U.S. 502 (1982) IN LIGHT OF SUBSEQUENT UNCAT RATIFICATION AND TREATY SUPREMACY PRINCIPLES

Quia Timet and the Prevention of Threatened Torture and Cruel, Inhuman or Degrading Treatment by Domestic Authorities

This Advisory Opinion analyzes the application of the equitable doctrine of quia timet — “because he fears,” the long-standing principle that a court may grant relief to prevent threatened harm before it occurs — to claims of imminent torture or cruel, inhuman or degrading treatment (CIDT) by domestic authorities in the United States. The Institute for the Advancement of Justice & Human Rights concludes that quia timet relief is not merely available but constitutionally and treaty-required where a complainant establishes a credible, particularized risk of conduct prohibited by Article 1 or Article 16 of the Convention against Torture (UNCAT).

Critical Threshold Finding: UNCAT Article 2(1) imposes an affirmative duty on each State Party to “take effective legislative, administrative, judicial or other measures to prevent acts of torture.” This duty cannot be discharged solely through post-hoc adjudication. Equitable jurisdiction to enjoin threatened state conduct is the principal judicial mechanism through which the prevention obligation is operationalized in U.S. courts. Because the prohibition is absolute and non-derogable, traditional ripeness and standing doctrines must be read in harmony with — not in derogation of — the treaty obligation.

The Opinion sets out evidentiary thresholds, the relationship of quia timet relief to traditional preliminary-injunction analysis, and the limits on judicial deference where non-derogable rights are at stake.

Applicability: This Advisory Opinion articulates the analytical framework applicable to all federal and state courts entertaining preventive claims under 42 U.S.C. § 1983, the All Writs Act, federal habeas corpus, and state constitutional and statutory equity jurisdiction. While the procedural vehicle varies by forum, the underlying treaty and constitutional obligation to prevent torture and CIDT is uniform across the United States.

Texas Supreme Court amicus: In the Interest of K.N., K.L., K.L., and K.L., Children

IAJ submits this brief to provide the Court with a unique analytical framework that has not been addressed by other amici curiae. No party has addressed the critical question of how the United States’ ratification of UNCAT informs the constitutional analysis this Court should undertake.

Critically, this brief addresses a fundamental gap in prior analysis: the distinction between the US instrument of ratification as deposited with the United Nations and the Senate Executive Reports that preceded it. The instrument deposited on October 21, 1994, constitutes the binding international commitment of the United States. While S. Exec. Rep. No. 101-30 (1990) reflects Senate deliberations, the deposited instrument represents the actual international obligation that, under Article VI of the Constitution, forms part of the “supreme Law of the Land.”

IAJ’s mission encompasses the recognition that human rights principles embodied in international treaties “resonate with the U.S. Constitution, and operate as keys to the extraction of the un-enumerated rights therein.” The consideration of human rights frameworks “speeds the recognition of rights that are systematically erased by institutions and courts, such as the right to family integrity, and the freedom of parent and child from severe pain and suffering through separation.”

This case presents an opportunity for this Court to recognize that strict scrutiny under Texas Constitution Article I, Section 37 must be informed by the proportionality standards embodied in UNCAT—but that strict scrutiny without adequate procedural safeguards is illusory and ineffective. The procedural safeguards this brief advocates are essential predicates to meaningful strict scrutiny analysis.

PARENT–CHILD SEPARATION IN THE UNITED STATES: A Unified Constitutional and Human-Rights Framework — Integrating the Constitutional Architecture of Troxel II with the IAJ Multi-Treaty Synthesis

This Framework is published by the Institute for the Advancement of Justice & Human Rights (IAJ) as a primary authority on parent–child separation in the United States and as the IAJ's contribution to the global authority on parent–child separation across all states bound by the international human-rights instruments analysed herein.

The constitutional architecture set out in Part II of this Framework — the eight constitutional holdings of Troxel II (Fit Parent Presumption, Strict Scrutiny Floor, Equal Protection Between Fit Parents, Non-Delegation Rule, Auditable Orders, Emergency Discipline, Epistemic Boundary, and Duty to Cooperate), the Madisonian institutional diagnosis, the coercive-architecture analysis, and the Kinship Continuity and Graduated Restoration module — is the work of Daniel J. Sturtevant, Ph.D. The IAJ acknowledges Dr. Sturtevant's authorship of that constitutional framework and incorporates it into the present Framework with attribution. The IAJ takes responsibility for the synthesis itself, for the integration with the multi-treaty architecture, for the interpretive positions identified as the IAJ's own, and for any errors of integration. The international architecture set out in Part II — the Six-Move framework, the multi-treaty convergence, the three-category taxonomy, the unified discriminatory-purpose architecture, and the case-archive evidentiary record — is the IAJ's own work, drawn principally from the IAJ Synthesis Memorandum (UNCAT and Jus Cogens: A Contemporary Perspective, 2026 Edition, IAJ Reference PP-2026-UNCAT-01) and from the IAJ's working documents on multi-treaty enforcement.

The synthesis itself — the holding-to-Move mapping, the analytical workflow, the bench card, and the audience-specific implementation guidance — is the joint product of the integration and is published by the IAJ under the present reference. Where the Framework adopts an interpretive position not shared by the underlying Troxel II project (notably, the qualification that the symmetry presumption between fit parents must yield where one parent uses proceedings as the instrument of coercive harm against the other), the position is the IAJ's own and is identified as such.

Today, ‘judicial torture’ properly covers (i) judicially ordered corporal punishment; (ii) court-process-linked torture/CIDT ; (iii) state acquiescence in private violence connected to proceedings. Judicial acquiescence to torture is tantamount to torture. This analysis examines international precedents and comparative law on judicial torture and cruel, inhuman, or degrading treatment (CIDT) across five critical areas of international legal authority. The research reveals a consistent international consensus that torture prohibition constitutes a jus cogens norm of customary international law, establishing absolute and non-derogable obligations for states regardless of exceptional circumstances. The prohibition dates back to the earliest days of the international formulation of human rights standards.

While regional and international judicial bodies have developed sophisticated jurisprudence defining torture and state obligations, significant implementation gaps persist in judicial contexts, particularly regarding procedural safeguards, accountability mechanisms, and effective remedies for victims. U.S. doctrine on torture are sparse, with examples such as Sosa v. Alvarez-Machain acknowledging torture as a law-of-nations violation under the ATS; Filártiga ; exclusionary principles; and the Medellín /Avena implementation tension.

Key findings demonstrate that international courts and treaty monitoring bodies have established complementary frameworks that collectively strengthen the global prohibition against torture, though enforcement mechanisms vary significantly across jurisdictions. Prosecutorial Misconduct and UNCAT Accountability: An IAJ Analytical Standard on Ethical Failure, Evidence Integrity, Execution-Architecture Abandonment, and State-Party Compliance

This Analytical Standard sets out the IAJ’s framework for evaluating prosecutorial misconduct as a compliance question under the United Nations Convention against Torture (UNCAT). It reframes the traditional treatment of prosecutorial misconduct — in which misconduct is analysed as an ethical failure of the individual attorney under state bar rules and, at most, as a due-process defect in the criminal case — and situates it inside the state-party accountability architecture UNCAT imposes on the United States. The Standard identifies four analytical dimensions along which prosecutorial conduct must be assessed for its consistency with the prohibition on torture and cruel, inhuman, or degrading treatment (CIDT): (1) ethical failure at the individual and institutional level; (2) evidence integrity, including the treatment of exculpatory and impeachment material under the Brady/Giglio/Napue lines and the Convention’s evidentiary-integrity requirements; (3) execution-architecture abandonment, meaning the failure of the prosecuting office and the surrounding institutions to preserve the domestic implementation machinery through which UNCAT’s obligations to investigate, prosecute, and remedy are actually executed; and (4) state-party compliance, meaning the aggregation of individual and institutional failures into the compliance record the United States owes the Committee against Torture and the Human Rights Committee.

The Standard is intended for prosecutors, defence counsel, disciplinary counsel, judicial-conduct commissions, human-rights investigators, and Committee-facing United States reporting staff who need a single analytical vocabulary for the cross-cutting question of how prosecutorial misconduct at the case level scales into the state party’s compliance with an absolute, non-derogable prohibition. It walks the reader through the four dimensions with practical indicators, evidentiary tests, and reporting checklists; it maps each dimension against the corresponding UNCAT articles and Committee jurisprudence; and it identifies the Institute’s position on where the current United States disciplinary architecture — dispersed across fifty state bar systems, immunised by prosecutorial-immunity doctrines, and largely divorced from human-rights review — falls short of the compliance the treaty requires. The Standard is the IAJ’s contribution to the reform conversation over how the United States, alone among peer state parties, treats prosecutorial misconduct as a private ethical matter rather than as a compliance failure of the state itself.

The Equivalence Representation and the Ex Post Facto Lockout: Why United States compliance with the Convention against Torture is not a political question awaiting congressional action; why the new offence a congressional cure supplies can never criminally punish the conduct of the past; and how the lockout is prevented

This Guide addresses a proposition heard repeatedly in United States discussions of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT) — that full compliance with the Convention is a political question awaiting congressional action, and that until Congress enacts the further criminal statute the treaty is thought to require, the People’s remedy is to wait. The Guide argues that the proposition is wrong twice over. It is wrong once because compliance with UNCAT is not, as a matter of United States law, a political question at all: what the Guide calls the equivalence representation — the representation the United States made to the Committee against Torture and to its treaty partners at ratification, to the effect that its existing body of federal and state criminal, civil, and constitutional law is functionally equivalent to the concrete duties the Convention imposes — is a binding representation of the state party, actionable in the ordinary courts by the ordinary tools of statutory and constitutional construction and by the ordinary remedial procedures the domestic law already supplies. And it is wrong twice because, even if the political-question framing were accepted at face value, the congressional cure it points to could never do the work the framing promises.

The second half of the Guide develops what the Institute calls the ex post facto lockout. Article I of the Constitution forbids Congress and the state legislatures from passing ex post facto laws; the doctrine, elaborated across Calder v. Bull through Stogner v. California and their progeny, is a peremptory bar on the retroactive criminalization of past conduct and on the retroactive imposition of greater criminal punishment for conduct already committed. It follows that whatever new criminal offence Congress may one day supply in the name of UNCAT compliance, that new offence, as a matter of United States constitutional law, cannot reach a single act of torture or of cruel, inhuman, or degrading treatment or punishment (CIDT) that has already occurred. To ask the survivors of past conduct to wait for a congressional cure is therefore to ask them to wait for a cure the Constitution has already promised will never reach them: the moment the cure is enacted, the door it opens for the future closes behind, and the past is locked out.

The Guide closes with the concrete legal architecture by which the lockout is prevented. The path runs through the tools already available under existing United States law and through the equivalence representation the United States has itself made to its treaty partners: the criminal statutes already on the books at both the federal and state level — the federal deprivation-of-rights, hate-crimes, and torture provisions and the fifty-state criminal codes of assault, aggravated assault, unlawful restraint, official oppression, and homicide — that in fact criminalize the very conduct UNCAT describes; the civil-remedy statutes and constitutional actions that reach the same conduct in the remedial dimension Article 14 of the Convention requires; and the interpretive doctrines — the Charming Betsy canon, the supremacy of ratified treaties under Article VI, the peremptory-norm status of the prohibition of torture, and the Institute’s Enhanced Constitutional Framework — that direct the ordinary courts to construe the domestic instruments in conformity with the treaty. The Guide is the Institute’s position on why the wait is neither politically necessary nor doctrinally coherent, and on why the ex post facto lockout can be prevented only by refusing the invitation to wait.

It treats domestic criminal enforcement as the single most important compliance mechanism the United States has committed to maintain under UNCAT Articles 4, 5, 6, 7, and 12, and it evaluates the current architecture against those articles rather than against domestic-law measures alone.

Collaborative Prosecution Framework: Joint State–Federal Enforcement of the Prohibition of Torture and Cruel, Inhuman, or Degrading Treatment in the United States

This Framework sets out a practical model for joint state and federal enforcement of the prohibition on torture and cruel, inhuman, or degrading treatment (CIDT) in the United States. It starts from the observation that neither sovereign, acting alone, has consistently produced accountability for the conduct UNCAT Articles 1 and 16 require states parties to prevent, investigate, prosecute, and remedy — and that the day-to-day criminal-law authority to reach the acts and the actors involved is split between federal statutes of narrow scope (18 U.S.C. §§ 2340–2340A, § 242, § 249, and their satellites) and a fifty-state patchwork of general criminal codes that in practice supply the primary charging vehicle. The Framework proposes that the two sovereigns act in concert, not in sequence, and it maps how they can.

The Structural Foreclosure of Effective Protection and Remedy for Rights-Violating Judicial Conduct in the Courts of the United States of America

An Investigative Finding on Judicial Immunity, Good-Behaviour Accountability, and the Limits of Judicial Self-Regulation Across State and Federal Court Systems, Assessed Against International Human-Rights Standards — “The Robed Sovereign and the Shield.”

This report is an investigative finding of the Institute for the Advancement of Justice and Human Rights. It examines a single structural question across both the federal and the state judiciaries of the United States: whether a person wronged by judicial conduct that violates protected rights has, in practice, any forum capable of supplying an effective protection or remedy. The Institute approaches the question not as an advocate for any party but as an investigator and a judge of compliance, and it writes in four registers kept distinct throughout — settled domestic doctrine, investigative findings of fact, interpretive synthesis, and proposed reform — so that what the law plainly holds is never confused with what the Institute concludes or recommends. The report carries no individual author; it states the position of the Institute.

The finding is that the protection and the remedy are foreclosed, and that the foreclosure is structural rather than incidental. Absolute judicial immunity shields the conduct of judges, federal and state alike, from civil liability; sovereign and Eleventh Amendment immunities close the alternative against the government; the conduct-discipline system excludes whatever can be characterized as “merits-related,” which is the form most rights-violating rulings take; recusal is decided by the challenged judge, and where an entire forum is disqualified the Rule of Necessity returns the matter to the disqualified rather than to a neutral substitute; the bar that might check the bench is licensed and disciplined by it; and the tenure condition of good Behaviour is enforced, if at all, only through the impeachment standard reserved for high crimes, so that the lower condition goes unenforced. No single one of these closures proves impunity, for a wrong might simply be rare. But their convergence upon the same class of wrong, set against a documented record of recurrence, is read here — by what the report calls the negative-space method — as the signature of structural impunity rather than of rarity.

The report assesses this domestic architecture against the international obligations the United States has assumed, keeping two planes distinct: the obligation itself — above all the duty to provide an effective remedy for a violation of rights (ICCPR Article 2(3); UNCAT Article 14) — and the domestic doctrine that determines whether that obligation is met. On the question of responsibility, the report adopts the settled position that the State and the individual answer concurrently and complementarily, never as alternatives (ILC Article 58): a wrong worked through a judicial organ engages the responsibility of the State, which owes reparation, while the honest or merely-erring judge is shielded by immunity as the State repairs the injury. Where, and only where, judicial conduct crosses a bounded threshold into torture or cruel, inhuman, or degrading treatment — a characterization the report confines to documented, cumulative patterns meeting defined conditions of severity, culpable intent, the exploitation of vulnerability, and foreclosed review, and which it expressly does not extend to ordinary error or the stress of litigation — immunity yields, and the individual becomes answerable in his own person, concurrently with the State, under a peremptory prohibition that admits no immunity. The honest judge is protected by the threshold, not by any rule that the State alone may ever answer.

The cure, the report concludes, belongs to the political branches. Under Medellín v. Texas, the implementation of a non-self-executing international obligation is the work of legislation — which is to say that Congress and the state legislatures already hold the power to close the gap, as Congress closed comparable gaps in implementing the Convention against Torture and the Genocide Convention. The report accordingly proposes a staged accountability architecture and marks its tiers by their legal security. The settled ground — a statutory standard of judicial conduct, discipline short of removal, mandatory recusal reform, disclosure, and, above all, a remedy that runs against the State rather than against the personal exposure of the honest judge — rests on established authority and leaves decisional independence intact. A further tier, the enforcement of the good-Behaviour condition through a forfeiture for proven misbehaviour adjudicated under Article III and short of impeachment, the report presents as a reserved, contested, and severable frontier, resting on the domestic constitutional record rather than on foreign practice and drafted so that the architecture stands whole without it. Comparative experience confirms that independence and accountability coexist in every peer democracy through non-legislative discipline and a State-borne remedy; the United States is an outlier in the combined effect of its immunities, and the report does not rest its contested tier on the comparators, which do not contain it.

The report sets the strongest case for the present settlement at its full strength — the case for independence, for immunity as functional protection, and for appeal as the proper corrective — and answers it on the merits, conceding what is true and holding what is not. Its conclusion is not that independence must yield to accountability, but that the two are not opposed: a judiciary independent in the person of the judge and answerable in the responsibility of the State, with the individual reached only where conduct crosses the peremptory line, serves both ends at once. What the Institute asks of its reader, and of the legislator above all, is engagement with its narrowest claim rather than assent to its boldest — that a structural foreclosure of protection and remedy on this scale, once seen, requires at least that its justification be supplied by evidence rather than asserted by tradition, and that the supplying is the legislature’s work, which no other branch can do in its place.

The Inviolable Root: Human Dignity as the Interpretive Foundation of the Prohibition on Torture and Cruel, Inhuman, or Degrading Treatment — A Comparative Survey of the World’s Constitutions and the United States Exception

Summary of the Review. This Review surveys the constitutions of the world and identifies a near-universal interpretive architecture in which the prohibition of torture and of cruel, inhuman, or degrading treatment or punishment (CIDT) is anchored in the constitutional recognition of human dignity as inviolable, non-derogable, and pre-political. The Review documents that this inviolable-dignity root is the textual or interpretive foundation from which national constitutional courts, supreme courts, and constitutional councils derive the absolute character of the prohibition: Germany’s Basic Law makes human dignity inviolable in Article 1 and treats it as the foundation of every other right; South Africa’s Constitution places dignity among its founding values and binds judicial interpretation to it; and most peer democracies of Europe, Latin America, the Commonwealth, and post-conflict Africa and Asia follow comparable architectures, whether through express constitutional text, supreme-law incorporation of international human-rights instruments, or both.

The central comparative finding — the United States is an outlier. The Review’s central finding is that the United States stands alone among the world’s mature constitutional democracies in the combined effect of its constitutional text and its interpretive doctrine. The U.S. Constitution does not contain the word “dignity,” does not name dignity among its founding values, and does not anchor the Eighth Amendment’s prohibition of “cruel and unusual punishments” in any inviolable-dignity foundation. Instead, the Eighth Amendment is construed through the “evolving standards of decency” doctrine and is hedged by a body of qualified-immunity, absolute-immunity, sovereign-immunity, state-action, and procedural-default rules that — alone among peer constitutions — permit the prohibition to be narrowed in practice rather than understood as the unconditional consequence of the inviolability of the person. The United States compounds this constitutional silence with reservations, understandings, and declarations attached to its instruments of ratification of UNCAT and the ICCPR that purport to narrow the treaty obligations to the contours of pre-existing domestic doctrine. The result is that the United States is the principal modern constitutional democracy whose legal order does not derive the prohibition on torture and CIDT from the inviolability of the human person, and whose domestic doctrine accordingly permits outcomes that would be constitutionally unthinkable in any peer jurisdiction surveyed.

The implication. The Review concludes that this outlier status is not a stylistic variance but a structural one. The absence of a dignity anchor generates measurable gaps in the doctrines, remedies, and interpretive defaults that U.S. courts reach when a litigant invokes the prohibition on torture or CIDT — gaps that explain why patterns of judicial and institutional conduct documented in the Institute’s companion investigative finding on structural foreclosure of remedy remain available, and recurring, in U.S. practice while their peer-jurisdiction analogues do not. The cure, the Review notes, lies open without constitutional amendment: human dignity may be recognized interpretively through the Charming Betsy canon of construction, through statutory implementation of the treaties the United States has already ratified, and through judicial recognition of dignity as the un-enumerated right from which the Bill of Rights itself proceeds.

Protections for Human Rights Defenders: Origins, State Obligations, and Enforcement -- with a Focus on the United States

Protections for human rights defenders are real but contingent, and they rest on a layered architecture rather than any single law. There is no dedicated binding treaty for defenders; instead the 1998 UN Declaration on Human Rights Defenders consolidates and restates rights that already bind states through instruments like the ICCPR — expression, assembly, association, fair trial, remedy — and frames not only a right but a responsibility, addressed to everyone and to civil-society institutions in particular, to take up that work. That responsibility is not a private cause of action, but it carries interpretive, legitimating, and standard-setting force, and defender status itself is never conferred by any authority: it is recognized from a person's peaceful, good-faith conduct. Enforcement is similarly layered. States owe duties to respect, protect (including a due-diligence duty against private-actor reprisal), and fulfil; UN monitoring through the Special Rapporteur and treaty bodies supplies scrutiny without hard enforcement; and the regional systems — strongest in the Inter-American framework — are where the standards acquire real teeth. The recurring lesson is that protection turns less on the defender-specific texts, which are largely non-binding, than on locating the binding right beneath them and an institution with both the jurisdiction and the will to enforce it.

The United States illustrates both the promise and the limits of this design, and does so paradoxically: strong outward projection of defender support as foreign policy, built on comparatively thin domestic scaffolding — and even the outward machinery (USAID, the democracy and human-rights programs) became highly volatile in 2025–2026. Domestically, the country has no dedicated defender statute or protection mechanism; constitutional guarantees protect much of what defenders do, but its core treaties are non-self-executing or unratified, and remedies against officials are uneven and often weak — narrowest against judges and prosecutors, who hold broad immunities. American defenders are therefore protected functionally but not formally, and the constitutional-and-statutory patchwork, in the IAJ's assessment, does not amount to a coherent protection system. The guide closes on the framework's dual character: defender protection is both a shield and a discipline — it shields peaceful, good-faith advocacy while demanding accuracy, non-violence, and respect for others' rights, and it is never a license or a credential of immunity. The safest statement of what it guarantees is modest but firm: not rescue or remedy, but that states must not obstruct or retaliate against defenders, must protect them from foreseeable harm, and must maintain an environment in which their documentation, advocacy, and reporting can proceed.

How to Personally Enforce the Torture Convention: A Practical Guide, in Impossible Steps, to Vindicating a Non-Derogable Personal Right Under United States Law

This Guide traces, step by step, what a person harmed by torture or by cruel, inhuman, or degrading treatment or punishment (CIDT) at the hands of a public official or of a private actor acting with the consent or acquiescence of a public official must actually do to vindicate the non-derogable personal right the United States has bound itself to protect — and demonstrates why, in the American legal order as it stands, each of those steps is at present impossible or nearly so. The Guide is written in the imperative voice of a practical manual, but its cumulative effect is a documentary indictment: the path exists in principle, but the doors are structurally closed.

The Guide walks the reader through every gate a personal-enforcement claim must pass: characterizing the conduct against the UNCAT Article 1 and Article 16 definitions with sufficient evidentiary specificity to survive judicial minimization; locating a cause of action within a domestic statutory framework in which UNCAT itself is expressly non-self-executing; overcoming the layered immunities (absolute judicial and prosecutorial immunity, qualified immunity, sovereign and Eleventh Amendment immunity, foreign-sovereign immunity where relevant); satisfying the state-action, color-of-law, and acquiescence tests as construed by U.S. courts; preserving federal review through Rooker-Feldman, abstention, and preclusion doctrines that trap the very rulings that inflicted the harm; navigating the reservations, understandings, and declarations attached to the U.S. instruments of ratification of UNCAT and the ICCPR; and reaching a remedy that under Article 14 of UNCAT must be effective, prompt, and adequate, but which U.S. doctrine reduces to a menu of options that in the ordinary case are none of the three.

Until then, the Guide is what its title advertises: a practical map of a road every step of which is presently closed.
