General Comment on IAJ Advisory Opinions

This General Comment sets out the institutional posture and limits of advisory opinions issued by the Institute for the Advancement of Justice & Human Rights, a California non-profit corporation structured by reference to the Paris Principles. It explains who the IAJ is and what its independent purpose comprises, situates IAJ advisory opinions within the broader institutional traditions of advisory work — international tribunals, the legal-academy synthesizing institutions, and Paris Principles–compliant national human rights institutions — and documents the continuing absence of a GANHRI-accredited NHRI in the United States, in light of which the IAJ performs NHRI-like documentation, investigation, advisory, and public-education functions. It states candidly what IAJ advisory opinions are not (they are not adjudications, not promulgations of law, not legal advice, and not predictions of success in any court or proceeding) and what they affirmatively are (reasoned civil-society analysis of questions of domestic and international human-rights law, addressed to complainants, counsel, courts, scholars, treaty bodies, and Special Procedures). It applies, by its terms, to every advisory opinion, recommendation, and analytical publication subsequently issued under the IAJ name, so that individual publications may incorporate it by reference rather than restate its caveats.

ON THE BOUNDED APPLICABILITY OF LEHMAN v. LYCOMING COUNTY CHILDREN’S SERVICES AGENCY, 458 U.S. 502 (1982) IN LIGHT OF SUBSEQUENT UNCAT RATIFICATION AND TREATY SUPREMACY PRINCIPLES

Quia Timet and the Prevention of Threatened Torture and Cruel, Inhuman or Degrading Treatment by Domestic Authorities

This Advisory Opinion analyzes the application of the equitable doctrine of quia timet — “because he fears,” the long-standing principle that a court may grant relief to prevent threatened harm before it occurs — to claims of imminent torture or cruel, inhuman or degrading treatment (CIDT) by domestic authorities in the United States. The Institute for the Advancement of Justice & Human Rights concludes that quia timet relief is not merely available but constitutionally and treaty-required where a complainant establishes a credible, particularized risk of conduct prohibited by Article 1 or Article 16 of the Convention against Torture (UNCAT).

Critical Threshold Finding: UNCAT Article 2(1) imposes an affirmative duty on each State Party to “take effective legislative, administrative, judicial or other measures to prevent acts of torture.” This duty cannot be discharged solely through post-hoc adjudication. Equitable jurisdiction to enjoin threatened state conduct is the principal judicial mechanism through which the prevention obligation is operationalized in U.S. courts. Because the prohibition is absolute and non-derogable, traditional ripeness and standing doctrines must be read in harmony with — not in derogation of — the treaty obligation.

Core Principle: Where a litigant identifies (i) a specific actor exercising state authority, (ii) conduct that, if performed, would constitute torture or CIDT under treaty and constitutional standards, and (iii) a credible likelihood that such conduct is imminent or continuing, federal and state courts have both the equitable authority and the treaty-imposed obligation to issue preventive orders. The Opinion sets out evidentiary thresholds, the relationship of quia timet relief to traditional preliminary-injunction analysis, and the limits on judicial deference where non-derogable rights are at stake.

Applicability: This Advisory Opinion articulates the analytical framework applicable to all federal and state courts entertaining preventive claims under 42 U.S.C. § 1983, the All Writs Act, federal habeas corpus, and state constitutional and statutory equity jurisdiction. While the procedural vehicle varies by forum, the underlying treaty and constitutional obligation to prevent torture and CIDT is uniform across the United States.

Texas Supreme Court amicus: In the Interest of K.N., K.L., K.L., and K.L., Children

IAJ submits this brief to provide the Court with a unique analytical framework that has not been addressed by other amici curiae. No party has addressed the critical question of how the United States’ ratification of UNCAT informs the constitutional analysis this Court should undertake.

Critically, this brief addresses a fundamental gap in prior analysis: the distinction between the US instrument of ratification as deposited with the United Nations and the Senate Executive Reports that preceded it. The instrument deposited on October 21, 1994, constitutes the binding international commitment of the United States. While S. Exec. Rep. No. 101-30 (1990) reflects Senate deliberations, the deposited instrument represents the actual international obligation that, under Article VI of the Constitution, forms part of the “supreme Law of the Land.”

IAJ’s mission encompasses the recognition that human rights principles embodied in international treaties “resonate with the U.S. Constitution, and operate as keys to the extraction of the un-enumerated rights therein.” The consideration of human rights frameworks “speeds the recognition of rights that are systematically erased by institutions and courts, such as the right to family integrity, and the freedom of parent and child from severe pain and suffering through separation.”

This case presents an opportunity for this Court to recognize that strict scrutiny under Texas Constitution Article I, Section 37 must be informed by the proportionality standards embodied in UNCAT—but that strict scrutiny without adequate procedural safeguards is illusory and ineffective. The procedural safeguards this brief advocates are essential predicates to meaningful strict scrutiny analysis.

PARENT–CHILD SEPARATION IN THE UNITED STATES: A Unified Constitutional and Human-Rights Framework — Integrating the Constitutional Architecture of Troxel II with the IAJ Multi-Treaty Synthesis

This Framework is published by the Institute for the Advancement of Justice & Human Rights (IAJ) as a primary authority on parent–child separation in the United States and as the IAJ's contribution to the global authority on parent–child separation across all states bound by the international human-rights instruments analysed herein.

The constitutional architecture set out in Part II of this Framework — the eight constitutional holdings of Troxel II (Fit Parent Presumption, Strict Scrutiny Floor, Equal Protection Between Fit Parents, Non-Delegation Rule, Auditable Orders, Emergency Discipline, Epistemic Boundary, and Duty to Cooperate), the Madisonian institutional diagnosis, the coercive-architecture analysis, and the Kinship Continuity and Graduated Restoration module — is the work of Daniel J. Sturtevant, Ph.D. The IAJ acknowledges Dr. Sturtevant's authorship of that constitutional framework and incorporates it into the present Framework with attribution. The IAJ takes responsibility for the synthesis itself, for the integration with the multi-treaty architecture, for the interpretive positions identified as the IAJ's own, and for any errors of integration. Dr. Sturtevant's underlying work retains its independent authority and citation form.

The international architecture set out in Part II — the Six-Move framework, the multi-treaty convergence, the three-category taxonomy, the unified discriminatory-purpose architecture, and the case-archive evidentiary record — is the IAJ's own work, drawn principally from the IAJ Synthesis Memorandum (UNCAT and Jus Cogens: A Contemporary Perspective, 2026 Edition, IAJ Reference PP-2026-UNCAT-01) and from the IAJ's working documents on multi-treaty enforcement.

The synthesis itself — the holding-to-Move mapping, the analytical workflow, the bench card, and the audience-specific implementation guidance — is the joint product of the integration and is published by the IAJ under the present reference. Where the Framework adopts an interpretive position not shared by the underlying Troxel II project (notably, the qualification that the symmetry presumption between fit parents must yield where one parent uses proceedings as the instrument of coercive harm against the other), the position is the IAJ's own and is identified as such.

Key Insight: Mutual Reinforcement
The most significant finding is that two independently developed frameworks (Troxel II + IAJ jus cogens Synthesis) arrive at structurally identical diagnoses and remedies, strengthening credibility of both projects. Today, ‘judicial torture’ properly covers (i) judicially ordered corporal punishment; (ii) court-process-linked torture/CIDT ; (iii) state acquiescence in private violence connected to proceedings. Judicial acquiescence to torture is tantamount to torture. This analysis examines international precedents and comparative law on judicial torture and cruel, inhuman, or degrading treatment (CIDT) across five critical areas of international legal authority. The research reveals a consistent international consensus that torture prohibition constitutes a jus cogens norm of customary international law, establishing absolute and non-derogable obligations for states regardless of exceptional circumstances. The prohibition dates back to the earliest days of the international formulation of human rights standards.

While regional and international judicial bodies have developed sophisticated jurisprudence defining torture and state obligations, significant implementation gaps persist in judicial contexts, particularly regarding procedural safeguards, accountability mechanisms, and effective remedies for victims. U.S. doctrine on torture are sparse, with examples such as Sosa v. Alvarez-Machain acknowledging torture as a law-of-nations violation under the ATS; Filártiga ; exclusionary principles; and the Medellín /Avena implementation tension.

Key findings demonstrate that international courts and treaty monitoring bodies have established complementary frameworks that collectively strengthen the global prohibition against torture, though enforcement mechanisms vary significantly across jurisdictions. The analysis identifies both convergent principles and critical gaps in ensuring judicial accountability for torture prevention and prosecution.
